TERMS OF SERVICE
Last updated: June 25, 2026
OVERVIEW
This website is operated by Ollie’s Great Bakery LLC. Throughout the site, the terms “we,” “us,” and “our” refer to Ollie’s Great Bakery LLC. We offer this website, including all information, tools, and Services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.
By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by these Terms of Service (“Terms”), including any additional terms and policies referenced herein or available by hyperlink. These Terms apply to all users of the site, including without limitation browsers, customers, vendors, merchants, and contributors of content.
Please read these Terms carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by them. If you do not agree to all the terms and conditions, then you may not access the website or use any Services. If these Terms are considered an offer, acceptance is expressly limited to these Terms.
Any new features or tools added to the site will also be subject to these Terms. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change, or replace any part of these Terms by posting updates to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the site following the posting of changes constitutes acceptance of those changes.
Our store is hosted by Shopify Inc., which provides the online e-commerce platform that allows us to sell our products and Services to you.
SECTION 1 - ALLERGEN POLICY
Facility & Cross-Contact
Ollie’s Great Bakery LLC is not an allergen-free bakery. Our kitchen handles and/or may be exposed to major food allergens, including milk, eggs, wheat, soy, peanuts, tree nuts, and sesame. Some ingredients, toppings, candies, sprinkles, decorations, drinks, packaging, or other items may also be produced by third-party suppliers in facilities that handle additional allergens.
Because our products are prepared in a shared kitchen using shared equipment, tools, storage areas, ovens, mixers, utensils, and workspaces, we cannot guarantee that any product is free from allergens or cross-contact.
Our products are not suitable for individuals with severe food allergies, anaphylactic allergies, or medical conditions requiring strict avoidance of cross-contact.
Gluten-Friendly, Vegan, or Other Dietary Items
Some products may be offered with gluten-friendly, vegan, or other dietary-style options when specifically listed on the product page.
These options are made according to the ingredient choices described, but they are not certified allergen-free and are not prepared in a dedicated allergen-free facility.
Gluten-friendly items are not celiac-safe. They are prepared in a kitchen that also handles wheat and gluten-containing ingredients.
Vegan, dairy-free, egg-free, or other dietary-style items may still be exposed to cross-contact with milk, eggs, wheat, peanuts, tree nuts, soy, sesame, or other allergens.
Ingredient Information and Changes
Ingredient information for standard menu items is available upon request. Ingredients, suppliers, decorations, toppings, colors, candies, sprinkles, packaging, and formulations may change without notice based on availability, supplier changes, substitutions, or seasonal product changes.
Product photos, descriptions, and menu names are provided for general reference and may not list every ingredient, supplier, topping, decoration, color, or potential allergen exposure.
Customer Responsibilities
If you have a food allergy, sensitivity, intolerance, celiac disease, or other dietary concern, you are responsible for contacting us in writing before placing an order.
If you are ordering for someone else, including a student, gift recipient, group, organization, event, class, chapter, or office, you are responsible for reviewing this Allergen Policy and informing all recipients before they consume our products.
By purchasing, serving, sharing, or consuming products from Ollie’s Great Bakery LLC, you acknowledge and assume the risk of allergens, cross-contact, food sensitivities, dietary restrictions, and ingredient changes.
Allergy and Dietary Requests
All allergy, dietary, or ingredient-related requests must be sent in writing before placing an order to OlliesGreatBakery@gmail.com.
Any accommodation is subject to our written confirmation of feasibility. We are not required to accept or fulfill allergy, dietary, or ingredient-related requests unless we have confirmed the request in writing.
Even when we confirm that we can attempt an accommodation, we cannot guarantee that any product will be free from allergens or cross-contact.
Absence of written confirmation from Ollie’s Great Bakery LLC means we cannot accommodate the request.
Medical and Safety Notice
Nothing on our website, product pages, emails, social media, labels, policies, or other materials constitutes medical advice. Customers and recipients with allergies, sensitivities, celiac disease, or other medical dietary concerns should consult a qualified medical professional before consuming our products.
In the event of a suspected allergic reaction or medical emergency, call 911 immediately.
Assumption of Risk and Limitation of Liability
To the fullest extent permitted by law, you agree to assume all risks related to allergens, cross-contact, food sensitivities, intolerances, celiac disease, dietary restrictions, ingredient changes, and other health responses.
To the fullest extent permitted by law, you agree to release and hold harmless Ollie’s Great Bakery LLC, its owners, employees, contractors, delivery drivers, suppliers, and service providers from any claims arising from allergic reactions, food sensitivities, dietary reactions, cross-contact, ingredient changes, or other health responses related to our products or Services.
Where such a release or limitation is not enforceable, our maximum liability is limited to the amount paid for the affected order.
SECTION 2 - DELIVERY POLICY
Delivery Time Frames
All deliveries are scheduled and completed within fixed delivery time frames based on our bakery’s routes. When placing an order, customers must select a delivery date and confirm the corresponding delivery time frame. By placing an order, you acknowledge and agree to the selected delivery date and time frame.
We make every effort to complete deliveries within the selected delivery window. Occasionally, deliveries may be completed up to one hour before or after the selected window due to traffic, campus access, order volume, route adjustments, or other unforeseen circumstances. During peak periods, including holidays, campus move-in, rush/recruitment periods, finals, and other high-volume dates, deliveries may be completed up to two hours before or after the selected window.
We cannot guarantee or honor custom delivery times outside of our standard delivery windows unless we have confirmed a separate written arrangement.
Customer and Recipient Responsibilities
Customers are responsible for providing complete and accurate delivery information at checkout. This may include the recipient’s full name, school, dorm or building, room or suite number, phone number, front desk or drop-off instructions, and any other information needed to complete the delivery.
If you are ordering for someone else, you are responsible for making sure the recipient knows a delivery is coming, is available during the selected delivery window, and responds promptly to delivery calls or texts.
Ollie’s Great Bakery LLC is not responsible for delays, failed hand-offs, misplaced orders, or delivery issues caused by inaccurate, incomplete, or outdated information provided at checkout.
Delivery Communication
Delivery recipients may receive delivery updates by text at the phone number provided at checkout. These messages may include delivery reminders, estimated time of arrival, tracking links, arrival notifications, and direct communication from the driver.
Customers may receive delivery updates by email at the email address provided at checkout. These messages may include order confirmations, delivery updates, tracking links, and confirmation that the order is arriving or has been delivered.
Order-related calls, texts, and emails are essential delivery communications and are not promotional messages.
Campus, Front Desk, and Approved Drop-Off Deliveries
Some schools, dorms, buildings, businesses, organizations, or event locations may require delivery to a front desk, concierge, lobby, mailroom, common area, or other approved drop-off location. When delivery to one of these locations is required or reasonably necessary, the order will be considered delivered once it has been left at that location.
After an order has been delivered to the recipient, front desk, concierge, lobby, mailroom, approved drop-off location, or safest available nearby location, Ollie’s Great Bakery LLC is not responsible for loss, theft, damage, melting, weather exposure, mishandling, or failure by the recipient or location staff to retrieve the order promptly.
No-Show Policy
If the recipient is required to meet the driver and is not present when the driver arrives, the driver will attempt to contact the recipient using the phone number provided at checkout.
If the recipient does not appear and does not respond to the driver’s calls or texts within 5 minutes of the driver’s arrival or first attempted contact, the driver may leave the order in the safest available nearby location. This may include, but is not limited to, a front desk, concierge desk, lobby, mailroom, building entrance, covered area, or another reasonable location near the delivery address.
Because we operate on fixed delivery routes and schedules, drivers cannot wait for extended periods, circle back later, attempt multiple hand-offs, or re-deliver the order on a different day due to recipient no-shows.
Once the order has been left in the safest available nearby location, the order is considered fulfilled and delivered. No refunds, credits, replacements, or re-deliveries will be issued for recipient no-shows, failure to respond, inaccurate phone numbers, incomplete delivery information, building access issues, or failure to retrieve the order promptly.
If there is no safe or reasonable place to leave the order, Ollie’s Great Bakery LLC may, at its sole discretion, return the order to the bakery, dispose of the order, or make another reasonable delivery decision. No refund, credit, replacement, or re-delivery is owed in these circumstances.
Weather, Road Safety, and Emergency Delays
The safety of our bakery team, delivery drivers, customers, recipients, and community comes first.
Ollie’s Great Bakery LLC reserves the right to delay, reschedule, pause, or modify deliveries due to unsafe weather, unsafe road conditions, campus closures, building closures, government advisories, natural disasters, power outages, vehicle safety concerns, emergencies, or any other conditions that we determine may make delivery unsafe, unreasonable, or impossible.
This includes, but is not limited to, snow, ice, flooding, severe thunderstorms, high winds, tornado warnings, hurricanes, tropical storms, road closures, accidents, unsafe rural roads, or other hazardous conditions.
If deliveries are delayed due to weather, road safety, or emergency conditions, affected orders will be moved to the next calendar day whenever reasonably possible. If conditions remain unsafe on the next calendar day, deliveries will continue to be moved to the following calendar day until we determine that conditions are safe enough to resume delivery.
Orders affected by weather, road safety, or emergency delays remain active and will be fulfilled on the rescheduled delivery date. Weather, road safety, and emergency delays are not eligible for cancellation, refund, store credit, or replacement solely because the delivery date was moved for safety reasons.
Ollie’s Great Bakery LLC will determine, in its sole discretion, whether conditions are safe for delivery and whether products should be held, remade, adjusted, or otherwise handled in order to complete the delayed delivery.
SECTION 3 - CANCELLATION & REFUND POLICY
Cancellation Policy
Because our products are perishable and each order requires advance preparation, ingredient planning, packaging, staffing, and a reserved delivery route spot, cancellations are limited.
Cancellation requests must be sent by email to OlliesGreatBakery@gmail.com. Cancellation requests sent by text message, social media direct message, voicemail, or any other method are not guaranteed to be received or accepted.
Cancellation eligibility is based on the scheduled delivery date in Eastern Time.
For standard bakery delivery orders:
Orders canceled two or more calendar days before the scheduled delivery date are eligible for a 100% refund.
Orders canceled the calendar day before the scheduled delivery date are eligible for a 50% refund.
Orders canceled on the scheduled delivery date are not eligible for a refund.
For example, if your order is scheduled for Friday:
Cancellation requests received on Wednesday or earlier are eligible for a 100% refund.
Cancellation requests received on Thursday are eligible for a 50% refund.
Cancellation requests received on Friday are not eligible for a refund.
Date Change Requests
Date change requests are not guaranteed and are subject to product availability, delivery availability, school availability, route schedules, and our ability to accommodate the request.
Date change requests made two or more calendar days before the scheduled delivery date may be accommodated when possible.
Date change requests made the calendar day before delivery or on the scheduled delivery date may be treated as a cancellation request and are subject to the cancellation terms above.
Same-day date changes, same-day delivery address changes, and same-day recipient changes are not guaranteed.
No Refunds After Preparation, Delivery, or Attempted Delivery
Once an order has been prepared, sent out for delivery, delivered, attempted, or left according to our Delivery Policy, it is not eligible for a refund, credit, replacement, or re-delivery unless Ollie’s Great Bakery LLC determines, in its sole discretion, that an exception is appropriate.
No refunds, credits, replacements, or re-deliveries will be issued for:
Recipient no-shows.
Failure to answer calls or texts.
Incorrect or incomplete recipient phone numbers.
Incorrect or incomplete delivery addresses.
Missing dorm, building, room, suite, or front desk information.
Building access issues.
Failure by a front desk, concierge, roommate, office, organization, or other third party to notify the recipient.
Failure to retrieve the order promptly after delivery.
Weather, road safety, or emergency delays handled under our Weather, Road Safety, and Emergency Delays policy.
Custom Orders, Catering Orders, Packages, and Special Event Orders
Custom orders, catering orders, large event orders, school package orders, subscription-style orders, semester packages, and other special orders may have separate cancellation, refund, payment, or deposit terms listed on the product page, invoice, quote, contract, or written communication from Ollie’s Great Bakery LLC.
If separate written terms are provided for a custom order, catering order, package, or special event order, those terms control over the standard bakery cancellation policy.
Gift Cards
Gift cards are non-refundable and cannot be exchanged for cash except where required by law.
Merch and Print-on-Demand Orders
Ollie’s Great Bakery merchandise, including but not limited to sweatshirts, T-shirts, hats, mugs, tumblers, and other branded items, may be produced on demand by a third-party printing partner. Because production may begin shortly after an order is placed, merch orders cannot be canceled, changed, returned, or exchanged once submitted.
We are not able to accept returns or exchanges for incorrect size, change of mind, or normal wear and tear.
If your merch item arrives misprinted, damaged, defective, or if the wrong item was sent, please email OlliesGreatBakery@gmail.com within 7 days of delivery with your order number and clear photos of the issue. We will review your request and, when the issue is confirmed, work with our printing partner to arrange an appropriate replacement or resolution.
Exceptional Circumstances
Ollie’s Great Bakery LLC reserves the right, at its sole discretion, to provide a partial refund, full refund, store credit, replacement, or other resolution in exceptional circumstances. Providing an exception in one situation does not require us to provide the same or similar exception in any other situation.
SECTION 4 - ONLINE STORE TERMS
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.
You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).
You must not transmit any worms or viruses or any code of a destructive nature.
A breach or violation of any of the Terms will result in an immediate termination of your Services.
SECTION 5 - GENERAL CONDITIONS
To the fullest extent permitted by law, we reserve the right to refuse, cancel, or limit Service or orders when we determine it is necessary or appropriate, including but not limited to suspected fraud, abusive behavior, unsafe delivery circumstances, inaccurate information, policy violations, unavailable products, capacity limits, or requests we cannot reasonably fulfill.
You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the Service is provided, without express written permission by us.
The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.
SECTION 6 - ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION
We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this site is at your own risk.
This site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. You agree that it is your responsibility to monitor changes to our site.
From time to time, we may make ingredient, packaging, or supplier substitutions based on availability. While we make every effort to keep product descriptions and allergen information current, ingredients and formulations may change without notice. Customers are responsible for reviewing our Allergen Policy and contacting us directly before ordering if they have specific dietary or allergen concerns.
SECTION 7 - MODIFICATIONS TO THE SERVICE AND PRICES
Prices for our products are subject to change without notice.
We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.
We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.
SECTION 8 - PRODUCTS OR SERVICES
Perishable Products
Our bakery products are perishable and may be affected by time, temperature, humidity, handling, weather, storage, and transportation after delivery. Once an order has been delivered, left at an approved drop-off location, handed to a recipient, or left according to our Delivery Policy, Ollie’s Great Bakery LLC is not responsible for melting, drying, smudging, damage, theft, mishandling, delayed pickup, failure to refrigerate, failure to store properly, or failure to consume within a reasonable time.
Because our bakery products are perishable food items, all bakery product sales are final except as expressly stated in our Cancellation and Refund Policy or as otherwise required by law.
Product Photos and Handmade Variations
We make every effort to display our products accurately, but all bakery items are handmade. Colors, frosting shades, decorations, sprinkle mixes, writing style, packaging, size, and final appearance may vary from product photos, examples, and prior orders. Device screens may also display colors differently.
Ingredient, Packaging, and Supplier Substitutions
We may make reasonable substitutions to ingredients, flavors, colors, decorations, candies, sprinkles, packaging, balloons, accessories, drinks, or other order components based on supplier availability, seasonal availability, product safety, delivery conditions, or operational needs. Substitutions will be made at our discretion and do not automatically qualify an order for cancellation, refund, replacement, or credit.
Campus, Catering, Organization, and Event Orders
Campus orders, catering orders, organization orders, school package orders, event orders, pop-up orders, and other special orders may have additional terms listed on the product page, quote, invoice, email, contract, or written communication from Ollie’s Great Bakery LLC. If separate written terms are provided for a specific order, those terms control over the general Terms of Service for that order.
References to schools, campuses, school colors, student organizations, Greek Life organizations, residence halls, departments, or events are for delivery, customization, and informational purposes only. Unless expressly stated in writing, Ollie’s Great Bakery LLC is not officially affiliated with, sponsored by, endorsed by, or authorized by any school, university, student organization, Greek Life organization, or campus department.
SECTION 9 - ACCURACY OF BILLING AND ACCOUNT INFORMATION
We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.
You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.
Accelerated Checkout and Autofill
Customers are responsible for reviewing all checkout information before submitting an order, including information filled in through accelerated checkout, saved addresses, browser autofill, Shop Pay, Apple Pay, Google Pay, PayPal, or similar services. Ollie’s Great Bakery LLC is not responsible for delivery issues caused by autofilled, outdated, incomplete, or incorrect customer or recipient information.
SECTION 10 - OPTIONAL TOOLS
We may provide you with access to third-party tools over which we neither monitor nor have any control nor input.
You acknowledge and agree that we provide access to such tools ”as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.
Any use by you of the optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).
We may also, in the future, offer new Services and/or features through the website (including the release of new tools and resources). Such new features and/or Services shall also be subject to these Terms of Service.
SECTION 11 - THIRD-PARTY LINKS
Certain content, products and Services available via our Service may include materials from third-parties.
Third-party links on this site may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or Services of third-parties.
We are not liable for any harm or damages related to the purchase or use of goods, Services, resources, content, or any other transactions made in connection with any third-party websites. Please review carefully the third-party's policies and practices and make sure you understand them before you engage in any transaction. Complaints, claims, concerns, or questions regarding third-party products should be directed to the third-party.
SECTION 12 - USER COMMENTS, FEEDBACK AND OTHER SUBMISSIONS
If, at our request, you send certain specific submissions (for example contest entries) or without a request from us, you send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, 'comments'), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us. We are and shall be under no obligation (1) to maintain any comments in confidence; (2) to pay compensation for any comments; or (3) to respond to any comments.
We may, but have no obligation to, monitor, edit or remove content that we determine in our sole discretion to be unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms of Service.
You agree that your comments will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your comments will not contain libelous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website. You may not use a false e‑mail address, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any comments. You are solely responsible for any comments you make and their accuracy. We take no responsibility and assume no liability for any comments posted by you or any third-party.
SECTION 13 - PERSONAL INFORMATION
Your submission of personal information through the store is governed by our Privacy Policy, which can be viewed here: Privacy Policy
SECTION 14 - ERRORS, INACCURACIES AND OMISSIONS
Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).
We undertake no obligation to update, amend or clarify information in the Service or on any related website, including without limitation, pricing information, except as required by law. No specified update or refresh date applied in the Service or on any related website, should be taken to indicate that all information in the Service or on any related website has been modified or updated.
SECTION 15 - PROHIBITED USES
In addition to other prohibitions as set forth in the Terms of Service, you are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service or of any related website, other websites, or the Internet; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl, or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the Service or any related website, other websites, or the Internet. We reserve the right to terminate your use of the Service or any related website for violating any of the prohibited uses.
SECTION 16 - ACCESSIBILITY
Ollie’s Great Bakery LLC is committed to making our website, online store, and Services reasonably accessible to all customers, including customers with disabilities.
We are continually working to improve the accessibility, usability, and readability of our website. Because our website is hosted on Shopify and may include third-party apps, tools, payment processors, delivery tools, embedded content, or links, some features may be controlled in whole or in part by third-party providers.
If you experience difficulty accessing any part of our website, placing an order, reading a product description, selecting a delivery date, completing checkout, or using any of our online Services, please contact us so we can assist you.
You can reach us at:
OlliesGreatBakery@gmail.com

When contacting us, please describe the issue, the page or feature involved, and the best way to reach you. We will make reasonable efforts to provide the information, item, or service you need through an accessible communication method or alternative ordering process where possible.
Nothing in this Accessibility section limits any rights you may have under applicable law.
SECTION 17 - CUSTOM DESIGNS, MESSAGES, AND CUSTOMER-PROVIDED CONTENT
Some products may allow customers to request custom colors, themes, wording, decorations, designs, inspiration photos, logos, school colors, organization colors, or other personalized details.
Custom requests are subject to our approval, product limitations, ingredient availability, design feasibility, scheduling, and our sole discretion. We reserve the right to refuse, modify, simplify, or decline any custom request that we determine is inappropriate, offensive, discriminatory, threatening, harassing, obscene, unsafe, unlawful, infringing, misleading, or outside the scope of what we can reasonably create.
Customers are responsible for making sure any requested names, phrases, spellings, dates, colors, logos, themes, and delivery details are accurate before submitting an order. We are not responsible for errors submitted by the customer.
If you submit or request the use of any logo, image, phrase, artwork, design, photograph, school mark, organization mark, character, or other third-party content, you represent that you have the right or permission to use it. We may decline requests that appear to involve intellectual property we are not authorized to reproduce.
Product photos, inspiration photos, mockups, prior designs, and examples are for general reference only. Custom bakery items are handmade, and the final product may vary in color, size, shape, writing style, decoration placement, sprinkle mix, packaging, and overall appearance.
If we determine that a custom request cannot be fulfilled as submitted, we may contact you for an alternative design, make a reasonable substitution, simplify the design, or cancel the affected item or order at our discretion.
SECTION 18 - DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY
We do not guarantee, represent or warrant that your use of our Service will be uninterrupted, timely, secure or error-free.
We do not warrant that the results that may be obtained from the use of the Service will be accurate or reliable.
You agree that from time to time we may remove the Service for indefinite periods of time or cancel the Service at any time, without notice to you.
You expressly agree that your use of, or inability to use, the Service is at your sole risk. The Service and all products and Services delivered to you through the Service are (except as expressly stated by us) provided 'as is' and 'as available' for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.
In no case shall Ollie's Great Bakery, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, Service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the Service or any products procured using the Service, or for any other claim related in any way to your use of the Service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the Service or any content (or product) posted, transmitted, or otherwise made available via the Service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.
SECTION 19 - INDEMNIFICATION
You agree to indemnify, defend and hold harmless Ollie's Great Bakery and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, Service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.
SECTION 20 - SEVERABILITY
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.
SECTION 21 - TERMINATION
The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.
These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.
If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).
SECTION 22 - ENTIRE AGREEMENT
The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
These Terms of Service and any policies or operating rules posted by us on this site or in respect to the Service constitutes the entire agreement and understanding between you and us and governs your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).
Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.
SECTION 23 - GOVERNING LAW
These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the State of North Carolina, United States, without regard to conflict of law principles.
You agree that any legal action or proceeding arising out of or related to these Terms of Service shall be brought exclusively in the state or federal courts located in Alamance County, North Carolina (or the closest federal court with jurisdiction), and you consent to the personal jurisdiction of such courts.
SECTION 24 - CHANGES TO TERMS OF SERVICE
You can review the most current version of the Terms of Service at any time at this page.
We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes.
